Actually, like Laurie said, nobody checks the contents of the auctions when they sign up. Everything's automated. There are just too many auctions for eBay employees to look closely at each one. They rely on the comunity to bring "bad" auctions to their attention. Once eBay determines that something is against their policy, they will pull it down right away. Until their notified, though, the auction goes on.
Is there someone who reads every post on this site before it's put up? No because that would be silly and waaay too time-consuming. When somebody reports the rare offensive post it's taken down or edited. Same with eBay and just about every other user-content site.
If you're that offended at the bird skins, report them. If eBay gets enough complaints and it's against their policy they'll take it down. I don't know enough about their policies to say whether this is illegal or not, but I have a feeling that it's kosher, though right on the limit.
