I, along with several members from area bird clubs, plan to attend some, if not all of the meetings. There are even some members who said they are willing to appear before the Game Commission to encourage them NOT to pass the law.

I dont understand why they specifically pick the Nanday? All birds can escape, all parrots can survive in the wild, breed, and destroy crops, all birds can carry the same diseases....

This was on the agenda October 2007 and mentioned in the resultant minutes.

Where was all the outcry then when it apparently got started? Why is this just being caught now?

Before the speculation turns into gospel, it needs to be determined what prompted this legislation. Without that knowledge there is no way to effectively counter the proposition.

There needs to be disclosure.

Anyone going to the meeting needs to be able to refute and rebut the "concerns" AND they need to be able to offer an alternative solution.

Don't personalize this folks, that doesn't work.

Another board I belong to posted this. The lady who posted it is a wildlife rehabber in the state of PA, she talked/e-mailed to the 'top dawg'. Pet nanday conures are safe and will be grandfathered in, the law is more stopping the future breeding and importation of new ones into the state.

QUOTE:
There has been much panic associated with the proposed regulation banning Nanday Conures in Pennsylvania. Petitions are circulating stating that none will be grandfathered and pets will be confiscated. This is a rumor that IS NOT TRUE!.

I contacted PGC Jason Decosky, head of Special Permits and Wildlife Conservation in the Harrisburg (main) office of the PA Game Commission and this is his reply to my inquiry regarding grandfathering:

Letter Quote:
Peggy,

The intent of this regulation was to prevent, by regulation, the importation of Nanday Conures into the Commonwealth. The PGC has done this with other species and through agency procedures grandfathered all existing animals in the Commonwealth as long as they had documentation that that animal was pre-act. The agency is not interested in existing Nandays, however in the interest of our native wildlife; we do not to allow the importation of more Nandays. A good example would be the Quaker or Monk Parakeet. The regulations did not spell out a grandfather clause but a internal letter stated that there was one. I hope this helps you out. I will be out of the office all week and will be back in on the 24th. Thanks Peggy!

Jason

Thanks for that info but it's still stupid and people should fight it even if their own bird is grandfathered. In this case, nandays aren't even that popular.

I'm guessing some tiny "colony" of nandays made it in the wild or something? I don't get these bans I really don't. Allowing them to pass, even if they allow grandfathering is just opening a door to banning more and more species.

Do not believe what you hear without proof. Look what the game commission has to say, in their own words of this proposed agenda for the upcoming meetings.

http://www.pgc.state.pa.us/pgc/lib/p...genda_2008.pdf
page 42.

Quote:
The Comission is also proposing to amend 137.1 to prohibit the importation, possession, sale, and release of all non-human primates and the Conure-Nanday, sometimes referred to as the Black-hooded Parakeet, in response to hman health/safety and wildlife habitat health purposes.
It mentions nothing of grandfathering. If they meant there to be a clause, it would be included. "Internal". Right!

I apologize for the length of this post. I found this on a parrot forum I belong to on LJ and thought that it might be helpful:

If you can't attend the Pennsylvania Game Commission hearing 1/27 - 1/29, you can call each of the Game Commission members and voice your opposition to the proposal to prohibit the "importation, possession, sale, and release" of Nanday conures in Pennsylvania. PLEASE CALL NOW. Contact information is provided below.

It is easy to make a call to a representative. A staff member will take your message and pass it along to the representative.

When you call, you can say:

"Hello, my name is [your name]
(and if you live in Pennsylvania, add: [ and I am a constituent from [your town]. }

I want to urge [ representative's name ] to do everything possible to make sure that proposal that is on the Game Commission Agenda for the January 27th to 29th meeting to amend 58 Pennsylvania Code Section 137.1 to prohibit the "importation, possession, sale, and release of non-human primates and Nanday conures in Pennsylvania " DOES NOT PASS. I ASK [ legislator's name ] TO VOTE NO ON THE PROPOSAL.

This issue is very important to me. Thank you."

After making your calls, if you haven't already done so, send an email to the Game Commission at pgccomments@state.pa.us to reiterate your opposition to the proposal to amend 58 Pennsylvania Code Section 137.1 to prohibit the importation, possession, sale, and release of non-human primates and Nanday conures in Pennsylvania.

Finally, please be sure to tell your friends and family about this rare opportunity and how they can help, too.

Thank you for all you do to help us fight for our rights to own and keep all of our animals.

The makers of our Constitution undertook to secure conditions favorable to the pursuit of happiness. They recognized the significance of man's spiritual nature, of his feelings and of his intellect. They knew that only a part of the pain, pleasure and satisfactions of life are to be found in material things. They sought to protect Americans in their beliefs, their thoughts, their emotions and their sensations. They conferred, as against the government, the right to be let alone - the most comprehensive of rights and the right most valued by civilized men. To protect that right, every unjustifiable intrusion by the government upon the privacy of the individual, whatever the means employed, must be deemed a violation of the Fourth Amendment. And the use, as evidence in a criminal proceeding, of facts ascertained by such intrusion must be deemed a violation of the Fifth.

The Game Commission meeting concerning Nanday's is this Sunday. Please have all of your letters, emails and phone calls in prior to. I have a lot of information I have been asked to cross post on every bird board I know about. So as soon as I can draw a breath throughout the day I'll post what I have just in case you don't catch up on other bird forums.

but for now please go to ThePerch.net

go to the Parrot Chatter section of the forum and scroll until you find the one that says Pennsylvania proposes ban on nandays or something like that.

currently it stands as this.

The meeting is open to the public.
if you attend and would like to speak as an individual if you are given any time a all you get 3 minutes to speak

if you represent an organization you get 5 minutes to speak.

The Commission is NOT interested in "emotionally charged You can't take my pet nanday from me because.

these people are doing their jobs, and they are charged with the duty to
1. Protect & preserve wildlife
2. Protect human life from potentially harmful critters that breed disease.

so have your facts, figures and proof ready when you attend.
if you are not a resident of Pennsylvania you can and should email, write and call them.

be on task to tell them why they are wrong, and why nandays do not threaten the wildlife of Pennsylvania, nor threaten the well being of people.

Ask them also for their studies and their proof. If they have none they really have no legs to stand on.

so please let your voice be heard.

Whn I have another minute or two I will see what I can do to cross post the information I was asked to.

so for now, lets pray that we can keep our nanday friends in Pennsylvania safe.

Someone said maybe they found a colony in Penn., But according to Audubon society there has never been a Nandy seen in the wild there since keeping tract of what birds are seen. So none in over 100 years ? So why would you make a law to control something that has not been seen in your area for 100 Years.
