Jadies bird nest negligent breeder

I purchased a Galah from Jadies Bird Nest in Katy Texas. The bird was shipped to me at my expense. Upon receipt of the bird it was sneezing. I later took the bird to Dr. Robert Dahlhausen of the Cincinnati Ohio area. He has a national reputation as an avian vet. His expert opinion and I have a letter to this effect; is that the bird aspirated during hand feeding.

I now have incurred $500 in vet expenses and the bird is still on oxygen, antibiotics, and brochial dialators. (oxygen my choice)

I am very angry about all of this.

I phoned her from the vet office and asked if the bird had been health checked as she had told me on the phone that she could assure me the bird was in good health. She said yes. When I asked that she fax those records to the vet's office while I was in his office she began to backpeddle. Later she confessed that she had lied and the bird had not been health checked at all.

Right now I am out a good deal of money and very angry. I am wondering if anyone has any ideas as a recourse of action. She is in Texas and I am in Ohio.

I would appreciate any help.

Just to clarify: This is a second Galah? Have you asked her for a refund directly and a reimbursement of your fees?

*You can of course file a claim in Small Claims court with all the documention that you have including emails that prove your case, you should have no problem winning a judgement.

If that's too expensive, you can go to FaunaClassifieds Home Page in the avian sector and state your case on the forum. They have sometimes been able to get a buyer's money back.

This is indeed a second Galah. I wanted a newly weaned Galah. I could not find one locally as it was out of season and stock was depleted in my area. I checked out the aviary as best I could. I have indeed asked for a refund and that she take the bird back. She blew me off. She initally stated she would assume partial 50% of the vet fees but stated "she could not take the bird back into her aviary at this time". Since then she has blown me off entirely. I have sent her the letter from the vet, and she now refuses to acknowlege any contact from me.

I have established an email paper trail where she does not deny that she lied about the health check and she does not dispute that I notified her the day I picked up the bird at cargo, that it was sneezing.

I cannot find an attorney who knows about how internet/paypal transactions work from state to state. So I don't know what my legal recourse is.

I am still open to any input and I thank you for yours.

Yes this is the second galah and also the second time that money has been brought into the issue. It's also the second time the sellers name has been plastered on the forum.

My advice/input, get your out of season galah chick that you coudn't wait for healthy then sort it out.

I must say, I personally don't like the practice of posting a name on a public forum. If there are issues, I like to see people work it out privately.

If you paid with Paypal, you can file a dispute with Paypal, and they will draft the money from the recipient, and return it to your account, they will probably ask you for all of your documentation. You can also try the BBB for the area of the seller, they take a while though. Other options would be to contact the sellers local ASPCA to look into overall conditions, and the The seller's local Chamber of Commerce. If you do the Paypal dispute, do not tell the other person you are doing it, because if they remove all funds, Paypal cannot get it back. I also know someone who contacted the post office, because sometimes they can help if their forms were filled out incorrectly, so if you had the bird flown, perhaps you could contact the airline, it might not get you any money back, but they might not let the person use their services anymore.

Sheesh! The baby Galah was not exactly totally out of season (my choice of terms was not the greatest) obviously because they were out there, it was just that locally none were available. And as for your sarcasm...my vet is the one who gave the diagnosis. She assured the chick was healthy and alleged that it had a health check. Delta Airlines cargo page states they require a health check. She also made this claim on the phone in the vet clinic which she later retracted and admitted she lied. Witnessed and documented. It was her fault...sorry if that upsets your apple cart since you have this insecurity about wanting to bash me all the time, but that is simply the facts darlin.

Robert Dahlhausen is my avian vet and his reputation is beyond reproach. So you are barking up the wrong tree this time sweetheart. You sympathy for this breeder is unwarrented.

Both the chick and the finances are an issue. If it happened to you, it would be an issue for you too, you're not fooling anyone.

Paypal only will arbitrate if it was a purchase made from Ebay. I already phoned them.

It was only meant to hopefully draw the attention of someone familiar with this breeder. Sorry to offend, I'm just searching for options.

I have tried to work it out privately, without success which is why I am searching for other options.

Paypal arbitrates only for ebay.
She lied about health checks.
She refuses to stand behind her stock.
I never saw her name on this forum before and I did look, sorry but I missed it. Perhaps her name was removed. Had it not been, perhaps I would have been alerted. If her name has been on here before, she must have issues.


To ship a sick chick and lie about health checks gives unethical a whole new meaning. This bird has been through the mill because of her negligence. And so have I for that matter.

I think that by now everyone knows on this board that I do not bash people and very rarely if ever show enomosity....but, breeders should be responsible. I live in the Houston area and I have heard this name more than a few times with people that have problems.

There are many good breeders in Texas breeding birds, this breeder that is mention is not the norm. (I deal with an excellent caring breeder) and it is a shame that the reputations of breeders here in Texas might be ruined by someone who only cares about the money and not the birds that she is placing.
