Jadies bird nest negligent breeder
I purchased a Galah from Jadies Bird Nest in Katy Texas. The bird was shipped to me at my expense. Upon receipt of the bird it was sneezing. I later took the bird to Dr. Robert Dahlhausen of the Cincinnati Ohio area. He has a national reputation as an avian vet. His expert opinion and I have a letter to this effect; is that the bird aspirated during hand feeding.
I now have incurred $500 in vet expenses and the bird is still on oxygen, antibiotics, and brochial dialators. (oxygen my choice) I am very angry about all of this. I phoned her from the vet office and asked if the bird had been health checked as she had told me on the phone that she could assure me the bird was in good health. She said yes. When I asked that she fax those records to the vet's office while I was in his office she began to backpeddle. Later she confessed that she had lied and the bird had not been health checked at all. Right now I am out a good deal of money and very angry. I am wondering if anyone has any ideas as a recourse of action. She is in Texas and I am in Ohio. I would appreciate any help. Thank you. If that's too expensive, you can go to FaunaClassifieds Home Page in the avian sector and state your case on the forum. They have sometimes been able to get a buyer's money back.

I cannot find an attorney who knows about how internet/paypal transactions work from state to state. So I don't know what my legal recourse is. I must say, I personally don't like the practice of posting a name on a public forum. If there are issues, I like to see people work it out privately.

If you paid with Paypal, you can file a dispute with Paypal, and they will draft the money from the recipient, and return it to your account, they will probably ask you for all of your documentation. You can also try the BBB for the area of the seller, they take a while though. Other options would be to contact the sellers local ASPCA to look into overall conditions, and the The seller's local Chamber of Commerce. If you do the Paypal dispute, do not tell the other person you are doing it, because if they remove all funds, Paypal cannot get it back. I also know someone who contacted the post office, because sometimes they can help if their forms were filled out incorrectly, so if you had the bird flown, perhaps you could contact the airline, it might not get you any money back, but they might not let the person use their services anymore.

I think that by now everyone knows on this board that I do not bash people and very rarely if ever show enomosity....but, breeders should be responsible. I live in the Houston area and I have heard this name more than a few times with people that have problems.
There are many good breeders in Texas breeding birds, this breeder that is mention is not the norm. (I deal with an excellent caring breeder) and it is a shame that the reputations of breeders here in Texas might be ruined by someone who only cares about the money and not the birds that she is placing. |
