The Unthinkable

Recently my brother in law phoned about a co-worker who was needing homes for forty pet birds due to declining health[40!].It got me thinking about my own birds and where they'd go if I die or became too sick to care for them.Since I only have two my neice could take them.Does anyone want to share thier plans for thier birds in the event "The Unthinkable" happens.

Ours are provided for in our Living Trust. Who gets them and who handles the funds for their well-bing. It's important to plan ahead. di

Its something I think a lot about but as of yet haven't done anything. It would be a multiple clause thing for me. If something happened to me only, Cricket and Benji I am sure would stay with my wife but Zoey and Sophie would most likely need to be rehomed. My wife isn't as into the birds as I am.

Well, after they finish picking our bones and raiding the cupboards, I just assumed they would start heading south raiding the neighbors homes as they follow the rivers to Central then South America.

I see them planning the first strike any day now.

Seriously, 40 birds? I thought I was nuts!

Being faced with this very issue because of my recent diagnosis, I have always had plans, and trust accounts sent up for the birds, however, it will have to be in iron clad writting.
I have people who have agreed to take the birds as well as back up people.
Emma Sydney and Ollie would stay with my husband as long as they could till they needed to be placed with one of the people I have chosen.

My attorney came to FWCAS and spoke with us about pet trusts. He left this brochure with us. It is most informative and important that you know the laws in your state.


If you have pets and you want to make sure
that they are taken care of after your death, you may be
interested to know that you can set up a document called a Pet Trust that will ensure that your wishes regarding the care of your pets are followed.

What is a Pet Trust?

A Pet Trust is a legal document that allows
you to make sure your pets are cared for properly
after you pass away.
I am leaving money to a family member
or friend to take care of my pets after my
death. Do I still need a Pet Trust?
Generally, it cannot be guaranteed that the
money and/or instructions you leave for a person
you trust (a family member or friend) will in
fact be used to care for your pets. To remedy
that problem, you can create a Pet Trust,
which is a legally binding document that
ensures the money you set aside for the care
of your pets will be used for that purpose and
that your pets will be well taken care of after
your death. Also, Pet Trusts, like most trusts,
are not subject to the caregiver's creditors,
marital disputes or bankruptcy.

Additionally, if the caregiver dies, the money you leave will
continue to provide for your pets, rather than
be distributed to the caregiver's heirs.
Does a Pet Trust only make sure the money
goes toward caring for my pets? What if I
have a pet with special health needs?
In addition to setting money aside for your
pets, your Pet Trust can be set up to give the
appointed trustee specific instructions regarding
your pets' health care, medication regimen
exercise and dietary needs. You can even designate
a preferred veterinarian and burial/cremation
plans for your pets.

Is a Pet Trust really legally binding?

Yes. Florida Statute §737.116 specifically
allows for the creation of a trust to provide for
the care of an animal. The Statute states that a
Pet Trust shall be subject to the same laws and
procedures as other trusts, and shall be legally
recognized as such.
It is common practice to set up a trust
(either as part of your Last Will and Testament
or through a Living Trust set up during lifetime)
to ensure that your family members will be
taken care of after your death. Why not make
sure that your pets will be taken care of too?
