So tempting...

Quakers are high up on my list of "wish birds" but unfortunately they are illegal in my state, California. Just recently a guy listed his two Quakers (male and female) on kijiji for a very reasonable price ($400 for the pair), including cage, toys, and food. I don't know how he got them, and not sure if I should ask. I don't really know how the whole law works, and it's just got me curious. Could someone get into trouble for buying those Quakers from him?

If it illegal to own them in your state then it is illegal to buy or sell them also unless your state has a clause that says it's ok to buy/sell in that state only or with a permit. California does not have that clause so it is illegal to own or breed quakers in that state. That being said, he probably bought them from someone else who had them and there are probably a lot of people who still have them illegally. As tempting as it is, I wouldn't get them. While it is unlikely you would get caught with them, if by some chance you do you would have to pay a fine and the birds would be put down. Not only that but I don't think it would be very easy to find a vet that would treat them if something were to come up.

Didn't know there were laws against certain species in the US like that...

Sounds like you need to find out the specifics of the law in your area, and if it's very certainly a "no" then encourage the guy to sell them to a different state so that they aren't in danger of being put down/not treated by vets.

Not sure where you'd find the law specifics though. Any bird specialists/breeders or zoos with a lot of birds in your area?

Thats sad to think that they could confiscate your beloved fids and actually put them down as opposed to allowing you time to relocate them. So cruel. However, I would think that any vet could be so heartless but to do anything but treat the animal. I agree though, I wouldnt risk the heartbreak.

So you think that the veterinarians, after all the years of education and training, all the money spent to get them where they are should put their livelihood on the line to treat what is illegal in their state?

The Vet would be obligated to perform critical care AND report it to the appropriate authorities.

I think if an illegal species is found you do have a certain ammount of time to relocate it to a legal state or even give it to a sanctuary or zoo.

I watched a news segment about a woman who kept a sugar glider in an illegal state. She was found out and told her options were to get it to another state or offer it up to the local zoo before it was destroyed. I can't see why that wouldn't apply to this guys quaker... if ever found out.

I personally wouldn't buy them because if they were ever reported it would break my heart to give them up.

That may be why he is selling them... he may have just moved to Cali and found out about the law.

wow you guys need some brushing up on your laws
I think it is just a thing with this board to spout fake laws *shakes head*

A vet in the state of california can legally treat ferrets and quakers which are both illegal, I need to look up what that exemption is called...

You cant legally buy the birds in question, you would have to buy the cage and the birds come with the cage.

If someone reported you with having an illegal animal, you have a limited time to remove them from the state before they are confiscated, which essentially they would be put down (ex angry ex boyfriend/girlfriend want to get back at you, I see that scenario a lot, oh and divorces too)

that being said, I know many people who bring them into ca straight from Arizona, infact you can find maps that show you routes without checkpoints

My vet alone sees many many quakers and ferrets, when you are looking for a vet ask them if they will see quakers, so if you do decide to buy the cage that comes with 2 birds keep in mind the risks involved, oh and dont keep them in view of your front door/window for this reason

our courts in ca are more than a little busy, to search out and remove every illegal animal would be suicidal and send us into bankruptcy (we can thank our friends on the border for that if you live in souther cally).

Therefore if someone you know reports you for whatever reason, most likely they wont put the time and effort into a very comprehensive search warrant if they go in and prove a search warrant is justifies to the judge to begin with, now if your illegal bird is in view of your front door then it is in public view and then you will be given a time limit to remove the animal, search warrant or no warrant.

Now say the animal is towards the back of the house and out of view, if they dont have a search warrant you are good to go, since most likely they will ask YOU if they can enter YOUR home, and YOU will do the smart thing and say NO, since YOU have no legal obligation with no search warrant to let them in your home.
Most people can avoid convictions all together if they would 1. keep their mouth shut (once you confess you are cheap to process through the court system, now if you dont most likely they will throw out the case) 2. Let them search you more than you are legally bound to let them

Now most people on here spouting all this junk would be the ones to see the police officer at their door and immediately break down, and give them the whole story, and watch they werent even there for that reason, then invite them to search their house.

Wow can you tell ive grown up with law enforcement and lawyers my whole life lol

The ferrets I can still somewhat understand....

But isn't making Quakers unlawful as pets an awful lot like the old adage of slamming shut the barn door after the horse done left? LOL

Heck... make it legal to trap and keep the little buggers. Might do some good.

Ferrets, I dont see why they are illegal, there has never been a case of a feral colony, domestic, not to many problems with them

now quakers on the other hand bring phone and elecrical line havoc wherever they go, take a visit to florida they are everywhere, so I understand that one

but I'm just spouting the legal stuff, since this topic/board in general seems really off base when it comes to that.

I know lots of people that keep the both take them to the vet, buy stuff, ect and have no problems but they are all aware of the chance they take
