Each city, county or jurisdiction has its own rules. Usually, cities allow a certain number of animals per residence. They may even allow a certain number of dogs, cats, horses, etc., often depending on historical issues that required ordinances to be passed. You need to check with your local zoning board for your specific rules.

I'm in the process of getting one started, but am going non-profit. There are many different ways to go, each with it's own limitations and restrictions. I've been working with another gal that is starting a rescue in a neighboring city, and we have been working with an attorney, especially to cover any area's like the unlikely event that one of us dies, or has a dibilitating accident. Who and what happens to the birds then... that type of thing. We decided we wanted to create something that survives our limited life spans.
Also, with the business license, especially for tax exempt status, it's best to do your research with the Dept of Revenue in your area because there are many ways to go.

The biggest problem you will run into will be noise ordinances and building requirements. Even if you have free reign to build anything you want in your area if they are loud then you will be fined. Contact your county court house and they should be able to point you to the correct location to find the information you need. Every area is different and no one can give you the correct answer except for someone in your own neighborhood who has an aviary.
