Jonathan Ramon Douglas Fleming, 22, and Simiona Paul John, 27, both appeared yesterday before Judge Philip Moran but were remanded without plea to appear with the third offender tomorrow.

Judge Moran said it was important they were all kept together when jointly charged.

John appeared in court on Friday and agreed to be remanded in custody until tomorrow. However, counsel Anne-Marie McRae had him recalled yesterday and made an application for bail.

The bail was granted with conditions including a curfew and no association with the co-accused.

Duty solicitor Charlotte Clifford applied for bail for Fleming so he could instruct counsel. She said Fleming, a fisherman, was not a flight risk as he had already arranged with his employer to not go on an upcoming fishing trip.

She said there was also not a problem of interfering with witnesses as all three men had made video statements to police.

John, Fleming and the third offender are jointly charged with burglary, and wilfully ill-treating 32 aviary housed birds causing them to die.

Fleming is also charged with giving a false statement to police and perverting the course of justice by conspiring with another person and convincing them to provide a false alibi statement.

Judge Moran said despite the nature of the allegations, there was no justification to remand them in custody, and bailed them both to re-appear on Wednesday.

Several bird lovers were in court yesterday to see the fate of the accused, among them Timaru Bird Club president Joy Agnew and vice-president Pat Rule.

Mrs Agnew said they would be back again on Wednesday and in stronger numbers.

A bird club meeting was being held last night and she said they would be encouraging members to go along to court.

People in Temuka, and throughout the country were still irate about the killings, and sending her emails, she said.

People are also making substantial donations to the Temuka Aviary Account at ANZ bank.

The money raised will go towards buying new birds and a security camera for the aviary.

Makes one wonder what their childhood was like or what is it that made them so sick and evil! They are cowards who took innocent lives. I personally do not think that people like this can be rehabilitated.

anyone who takes the lives of innocent animals is not right in the head. I rather disagree with the bail decision!

Some people defy all laws of common decency. Those poor birds, I hope those "men", if you can even call them that, go down for a long time and suffer for what they did.

A savage attack at the Temuka aviary has left 32 birds dead - many of them decapitated and their remains scattered around the domain.

Temuka police took photos and fingerprints yesterday morning in a bid to find those responsible for the attack in which heads and feathers were ripped from the birds' bodies. Twenty were left alive.

While the popular talking parrots at the aviary have now been silenced, one of them Willy has probably left a few clues and is likely to have put up quite a fight when he was attacked and killed, Sergeant Graham Sharpe said.

"It is just mindless and will be treated as a very serious offence," he said.

"Whoever did this probably has some scratches or bites on them as the parrot would have put up a fight.

"We want to hear from anyone who may have any information."

Mr Sharpe could not say how many people were involved.

Timaru Bird Club vice-president Pat Rule was in shock yesterday following the attack. The birds had been donated to the aviary and some had been bought by the Timaru District Council.

"I cannot describe a person who would do this but they have probably been torn to pieces. Willy the parrot was quite vicious and one of the cockatoos would have put up a big fight too. Someone will have been badly savaged by them."

He estimated the birds were worth around $4000. Among the dead were cockatoos, cockatiels, budgies, canaries and rainbow lorikeets.

Some of the birds were sitting on eggs, he said.

Midlands Contracting worker Mariee Williams was among the first people on site yesterday morning.

"I was horrified. It is just so devastating," she said.

I was devastated to see the news of the birds being killed. These birds have been a legacy in Temuka for many years and enjoyed by young and old alike (many of us still rmember Harry the talking parrot who was a big drawcard for many years).

Whovever did this should be made to pay - they are mindless scum!

My Daughter will be devastated by this news as she regularly goes to visit the birds when we are in Temuka. There seems to be quite a few of these mindless crimes in Temuka. The sculpture was another victim (twice I believe) and the primary schools have also been mindlessly attacked. This latest act is just unbelievable. We sincerely hope the people who did this are caught and duly punished. The trouble is will the punishment fit the crime? Thats half the problem with society these days we are all far too PC. Punishments rarely fit the crimes and the people who commit them know this and are not bothered.

I am absolutly horrified, distraught, upset, shocked and appauled at this attack, I can not beileve a human being can do such a thing to such an amazing animal, what motive would they possibly have to kill these birds? I couldnt stop crying this morning at the thought of what these bird endured. and I feel that I need to do something about it. Im so affected by this story that I want to help this aviary out as much as I can. This is truely a sad day for the world of animal cruelty.

What the heck is happening in Temuka? Congratulations to whomever commited this disgusting crime, you have put the spotlight on Temuka for all the wrong reasons! I trust that the local police will not only catch these people but NAME AND SHAME THEM! I hope that the sentence given will reflect the serious nature of the crime!

I read with horror and disgust of the senseless slaughter of these wonderful birds. The person or persons who did this do not warrant being called human beings, they are just plain scum worse than something unmentionable that you might accidentially stand on.

My thoughts go to all those at the avaiary who loved and cared for these birds and those who derived pleasure from seeing them. Let us hope that the eveil perpetrator/s will be apprehended before they can do this again.

I think what the scumbag/s have done is disgusting! These poor birds didnt stand a chance against the mindless thugs. Whoever you are I hope they get you! Your actions have affected all South Canterbury familys that often go to enjoy the birds.
