Question Can anyone tell me what type of bird this is????

First let me explain why I am holding it. It flew into the window and I had to save him from Beauregard (the dog). He wanted to play with it. Anyway, I thought that it was a humming bird, but I can't find any pics that look like it, so I thought that I would try here (sorry for the crappy pics, I had to take them with my cell):

The sad news is that I was unable to locate a rescue in the area (no one would answer the phone and their website...completely useless!) and he died about 2 hours later.

Thanks for your help.

Sorry to hear that :( But wow it is beautiful. Definitely not a hummer though. I've never seen these in Texas.

I think that I finally found it: Prothonotary Warbler (or Golden Swamp Warbler). I found a picture and they look almost identical. Here is the link.

I did everything I could think of to save him. Even left a message at the rescue place (they called the next day at 10, over 12 hours after I called ).
